These Terms and Conditions of Use (referred to as the "Terms of Use") govern your use of the InsightPact website located at https://www.insightpact.com/ and all its associated sites linked to https://www.insightpact.com/, including InsightPact sites worldwide (collectively, the "Site"). The Site is owned by InsightPact Ltd. ("InsightPact") and its licensors. By accessing and using the Site, you agree to abide by these Terms of Use. If you do not agree with these terms, please refrain from using the Site.
InsightPact reserves the right, at its sole discretion, to make changes, modifications, additions, or removals to these Terms of Use, at any time. It is your responsibility to regularly review these Terms of Use for any updates. Your continued use of the Site after any changes are posted indicates your acceptance and agreement to the revised terms. As long as you comply with these Terms of Use, InsightPact grants you a personal, non-exclusive, non-transferable, and limited privilege to access and use the Site.
The "Content" on the Site includes all text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork, and computer code. This Content encompasses the design, structure, selection, coordination, expression, "look and feel," and arrangement of such elements. InsightPact, its licensors, or other authorized parties own, control, or license this Content, and it is protected by trade dress, copyright, patent, trademark laws, and various other intellectual property rights and unfair competition laws.
Unless expressly permitted in these Terms of Use, you are not allowed to copy, reproduce, republish, upload, post, publicly display, encode, translate, transmit, or distribute any part of the Site or its Content in any manner, including "mirroring," to any other computer, server, website, or medium for publication or distribution, or for any commercial purposes, without the prior written consent of InsightPact.
However, InsightPact does grant permission for you to use information related to InsightPact products and services, such as data sheets, knowledge base articles, and similar materials, which have been intentionally made available for download from the Site. In using such information, you must adhere to the following conditions: (1) retain all proprietary notice language in all copies of the documents, (2) use the information solely for your personal, non-commercial informational purposes, refraining from copying or posting it on any networked computer or broadcasting it in any media, (3) refrain from making any modifications to the information, and (4) not make any additional representations or warranties related to such documents.
When using the Site, you must adhere to the following guidelines:
Do not use any automated devices, programs, algorithms, or similar methods (e.g., "deep-link," "page-scrape," "robot," "spider") to access, acquire, copy, or monitor any part of the Site or its Content. Also, refrain from attempting to bypass the navigational structure or presentation of the Site to obtain materials, documents, or information not intentionally made available through the Site. InsightPact reserves the right to prohibit such activities.
Avoid unauthorized attempts to access any portion or feature of the Site, InsightPact's servers, or any connected systems or networks, through hacking, password "mining," or any other illegitimate means.
Refrain from probing, scanning, or testing the vulnerability of the Site or any connected network or breaching the security measures or authentication mechanisms of the Site. Additionally, do not attempt to trace or seek information about other users, visitors, or stakeholders of InsightPact, including InsightPact accounts that do not belong to you, with the intention of revealing personal identification or information.
Agree not to take actions that place an unreasonable or disproportionately large burden on the Site's infrastructure, InsightPact's systems or networks, or any connected systems or networks.
Do not use any device, software, or routine to interfere or attempt to interfere with the proper functioning of the Site or disrupt any transactions conducted on the Site or the use of the Site by others.
Avoid forging headers or manipulating identifiers to conceal the origin of any message or transmission sent to InsightPact through the Site or any associated services. Do not impersonate or misrepresent yourself as someone else or any other individual or entity.
Refrain from using the Site or its Content for any unlawful or prohibited purposes as specified in these Terms of Use. Do not solicit or engage in any illegal activities or actions that infringe on the rights of InsightPact or others.
By using the Site, you agree to comply with these guidelines and acknowledge that any violation may result in appropriate actions being taken by InsightPact to enforce these Terms of Use and protect its rights and interests.

Moreover, by using the Site, you acknowledge and understand that Internet transmissions are not entirely private or secure. While InsightPact takes reasonable measures to protect your information, there is a possibility that any messages or information you send to the Site could be read or intercepted by others, even if there is a notice indicating that specific transmissions, such as credit card information, are encrypted. It is essential to exercise caution and discretion when sharing sensitive or personal information online.

You agree to indemnify and hold InsightPact, its officers, directors, shareholders, predecessors, successors in interest, employees, agents, subsidiaries, and affiliates harmless from any demands, loss, liability, claims, or expenses (including attorneys’ fees) made against InsightPact by any third party due to, arising out of, or in connection with your use of the Site.
In the event of any violation of these Terms of Use, InsightPact reserves the right to take appropriate actions, which may include disclosing information about you (including your identity) to address any investigation or complaint related to your use of the Site. Such actions may be necessary to identify, contact, or initiate legal proceedings against any individual causing harm or interference with InsightPact's rights, property, or the rights and property of Site users, including InsightPact's customers. Additionally, InsightPact may disclose information as required by applicable law, regulations, legal processes, or government requests, including sharing information with other entities for the purposes of fraud protection.
By using the Site, you acknowledge and agree that any transmittals or communications you have with InsightPact through the Site may be preserved and disclosed if deemed necessary by InsightPact to (1) comply with legal processes, (2) enforce these Terms of Use, (3) respond to claims of rights violations by others, or (4) protect InsightPact's rights, property, employees, Site users, and the public.
In the event of a violation of these Terms of Use, InsightPact has the discretion, without prior notice, to terminate your access to the Site or block your future access if it determines that you have violated these Terms of Use or any other associated agreements or guidelines. You acknowledge that any violation by you of these Terms of Use may be deemed an unlawful and unfair business practice, causing irreparable harm to InsightPact. In such cases, you agree to InsightPact's right to seek injunctive or equitable relief, in addition to any other available remedies under law or equity.
InsightPact may also terminate your access to the Site in situations such as requests from law enforcement or government agencies, self-initiated account deletions, discontinuation or significant modification of the Site or its services, or unforeseen technical issues.
In the event InsightPact takes legal action against you for violating these Terms of Use, you agree to pay all reasonable attorneys' fees and costs incurred by InsightPact as a result of such action, in addition to any other relief granted to InsightPact. You understand that InsightPact will not be held liable to you or any third party for any termination of your access to the Site resulting from a violation of these Terms of Use.
You agree that all matters relating to your access to or use of the Site, including any disputes, shall be governed by the laws of the Kingdom of Thailand.
In the event of a dispute between you and InsightPact ("the Parties"), both parties will make good faith efforts to resolve the dispute within 30 days of its occurrence. If the dispute remains unresolved after the 30-day period, it shall be submitted to binding arbitration in accordance with the rules of the Thailand Arbitration Center (THAC) in effect at that time.
The arbitration proceedings will be conducted in English and held in Bangkok, Thailand, before a single arbitrator selected by mutual agreement of the Parties, following the THAC Expedited Commercial Rules then in effect. During the arbitration process, either party may seek interim injunctive relief from any competent court to protect its rights until the arbitration is resolved. The arbitrator may also grant equitable or injunctive relief consistent with the remedies and limitations outlined in this Agreement.
Notwithstanding the above, each party has the right to petition a competent court for any order necessary to protect its rights or property without violating or waiving the governing law and arbitration section of this Agreement. Such court petitions will not affect the arbitrator's powers, including the authority to review the judicial decision.
Both parties agree that the courts in Bangkok, Thailand, have jurisdiction to issue any order under this subsection, subject to the confidentiality requirements specified in Section 14.
Any feedback or information you provide on this site shall be considered non-confidential. InsightPact may freely use such information without any restrictions.
